PhotoPost.AI Terms of Service

Effective date: August 25, 2026

These Terms of Service govern access to and use of PhotoPost.AI, an AI-assisted social media communication and publishing service operated by Touch & Store LLC, 2915 Ogletown Road, #1470, Newark, DE 19713, United States. PhotoPost.AI is intended exclusively for business and professional use.

About PhotoPost.AI

PhotoPost.AI is an AI-assisted social media communication and publishing service operated by Touch & Store LLC, 2915 Ogletown Road, #1470, Newark, DE 19713, United States (“Touch & Store”, “PhotoPost.AI”, “we”, “us” or “our”).

PhotoPost.AI helps businesses understand and organize their social media communication, prepare content adapted to their activity, receive recommendations about when and how often to publish, find topics to communicate about, and, where available, schedule or publish approved content to connected social networks.

These Terms of Service (“Terms”) govern access to and use of PhotoPost.AI.

By creating an account, accessing or using PhotoPost.AI, you agree to these Terms.

Eligibility and Business Use

PhotoPost.AI is intended exclusively for business and professional use.

You may use the Service only in connection with an eligible business, professional activity or organization that you operate or are authorized to represent.

PhotoPost.AI is not offered for personal, household or purely consumer use.

You must be at least 16 years old.

If you are under the age of legal majority in your jurisdiction, you may use PhotoPost.AI only where you are legally permitted to act for the relevant business, and you may enter into a paid subscription only if you have the legal capacity to do so or the subscription is entered into by an authorized person with such capacity.

You represent that the information you provide about yourself, your business and your authority to use the Service is accurate.

Your Account

You are responsible for maintaining accurate account information and for keeping your login credentials secure.

You must not knowingly allow unauthorized persons to use your account.

You are responsible for activity performed through your account except to the extent that such activity results from a security failure attributable to PhotoPost.AI.

You must notify us promptly if you believe your account has been compromised or used without authorization.

The Service

Depending on your plan, connected networks, provider permissions and the features currently available, PhotoPost.AI may provide:

  • business and activity personalization;
  • AI-assisted preparation of social media content;
  • assistance in finding topics to communicate about;
  • recommendations regarding publication frequency;
  • recommendations regarding relevant publication times;
  • connection to supported social networks;
  • content scheduling;
  • publication to connected social networks;
  • other features clearly identified within the Service.

PhotoPost.AI may evolve over time.

The availability of a feature may depend on your plan, connected social network, third-party permissions, technical limitations, geographic availability or provider approval.

A description of a feature does not override a limitation that is clearly displayed to you in the Service.

Free Trial

PhotoPost.AI offers a free Trial designed to allow eligible users to evaluate the Service before subscribing to a paid plan.

The Trial:

  • is free of charge;
  • may be used for a period of up to one month;
  • includes up to 7 publications during the Trial period;
  • allows those publications to be used at the user’s own pace during the Trial period;
  • supports one connected social network;
  • does not include scheduling;
  • does not include video publishing at launch.

The Trial does not impose a requirement to publish once per day or according to any other fixed daily cadence.

Unused Trial publications expire when the Trial ends and have no cash or monetary value.

The Trial does not automatically convert into a paid subscription.

To continue using paid Creator features after the Trial, the user must actively choose to subscribe to Creator.

Creator Subscription

Creator is PhotoPost.AI’s paid launch plan.

Creator is currently offered at €9.90 excl. tax per month, unless another price is clearly displayed and accepted before purchase.

Creator currently includes, subject to availability:

  • the assistance and capabilities available during the Trial;
  • help finding topics to communicate about;
  • publication scheduling;
  • use of several supported connected social networks;
  • up to 30 publications per month;
  • review and approval of content before publication.

The 30-publication allowance is a monthly usage limit.

Publications may be used across supported connected networks selected by the user, subject to the counting rules displayed in the Service.

PhotoPost.AI may introduce additional usage limits for resource-intensive features where necessary.

Any such customer-facing limit must be clearly disclosed before the relevant feature is used.

Internal technical credits, processing units or internal cost mechanisms used by PhotoPost.AI do not create a monetary balance or payment entitlement for the user unless expressly stated otherwise.

Prices, Billing and Renewal

Paid subscriptions are billed according to the price and billing period displayed before purchase.

Creator is currently billed monthly.

A Creator subscription renews for successive monthly periods until cancelled, unless otherwise stated and accepted when the subscription is purchased.

Before completing a purchase, the applicable subscription price and any amounts required to be disclosed at checkout will be shown to the user.

Payment processing may be provided by an authorized third-party payment provider.

Where payment-card information is collected directly by the payment provider, PhotoPost.AI does not receive or store the full payment-card details.

Cancellation

You may cancel a Creator subscription at any time using the cancellation method made available by PhotoPost.AI.

Cancellation prevents future renewal of the subscription.

Unless otherwise required by applicable law or expressly stated at the time of cancellation, cancellation does not terminate access immediately: paid features remain available until the end of the current paid billing period.

No new subscription fee will be charged for the following billing period after cancellation has taken effect.

Refunds and Mandatory Rights

Except where required by applicable law or expressly agreed by PhotoPost.AI, subscription fees already paid are not automatically refundable solely because a subscription is cancelled before the end of the current billing period.

Nothing in these Terms limits any mandatory rights that cannot legally be excluded or restricted under applicable law.

Requests relating to billing or refunds may be submitted to contact@photopost.ai.

AI-Assisted Content

PhotoPost.AI uses artificial intelligence and automated processing to assist with analysis, recommendations and content preparation.

AI-generated or AI-assisted content may be incomplete, inaccurate, inappropriate or unsuitable for a particular business, audience, jurisdiction or social network.

All content must be reviewed and approved by the user before publication.

PhotoPost.AI provides suggestions and assistance. The user keeps the final decision about what is published.

You remain responsible for checking the accuracy, legality and appropriateness of content you approve and publish.

PhotoPost.AI does not provide legal, tax, financial, medical or other regulated professional advice through generated social media content.

Content Safety and Automated Screening

PhotoPost.AI may use automated analysis, safety systems and content-classification mechanisms, including safeguards provided by third-party artificial intelligence providers, to evaluate text, images, media, instructions or other material submitted to the Service.

Where such systems identify content that appears to be unlawful, harmful, abusive, deceptive, infringing, unsafe, prohibited by these Terms or inconsistent with applicable third-party platform policies, PhotoPost.AI may refuse to analyze, generate, transform, schedule or publish that content.

PhotoPost.AI may return an error, warning or request for different input when a submitted request cannot be processed safely or in accordance with applicable rules.

Automated safety systems are not infallible.

They may fail to identify problematic material or may incorrectly reject permissible material.

Their operation does not replace the user’s responsibility to ensure that submitted and published content is lawful, accurate and compliant with applicable rights and platform policies.

The absence of a warning, refusal or automated safety flag does not mean that PhotoPost.AI has approved, verified or certified the legality, accuracy or compliance of the content.

Processing by Artificial Intelligence Service Providers

To provide certain AI-assisted features, PhotoPost.AI may transmit information reasonably necessary to authorized artificial intelligence service providers.

Depending on the requested feature, this information may include text, business context, images or other media submitted by the user.

Such processing is limited to what is reasonably necessary to provide the requested Service and is subject to the data-protection arrangements described in our Privacy Policy and, where applicable, our Subprocessors information.

Responsibility for Submitted and Published Content

You are responsible for content that you submit to PhotoPost.AI and for content that you approve, schedule or publish through the Service.

In particular, you are responsible for ensuring that:

  • factual statements and commercial claims are accurate;
  • required disclosures are included;
  • you have the necessary rights to use photos, videos, audio, music, logos, trademarks, text and other materials;
  • you have the necessary rights or permissions relating to persons appearing in submitted media where required;
  • content complies with applicable laws;
  • content complies with the rules of the social networks to which you choose to publish;
  • promotions, advertisements, offers and regulated communications comply with rules applicable to your business.

PhotoPost.AI may assist in preparing or checking content, but that assistance does not transfer responsibility for the final approved publication to Touch & Store LLC.

User Content and Ownership

“User Content” means photos, videos, audio, text, logos, documents, business information and other materials that you upload, provide, connect or otherwise make available through PhotoPost.AI.

You retain ownership of your User Content.

You grant Touch & Store LLC a non-exclusive, worldwide, limited licence to host, copy, process, analyze, adapt, transform and transmit your User Content only to the extent reasonably necessary to:

  • provide PhotoPost.AI;
  • perform actions you request;
  • generate and prepare content for you;
  • store or process content using authorized service providers;
  • transmit approved content to the social networks you select;
  • maintain, secure and support the Service.

This licence does not transfer ownership of your User Content to Touch & Store LLC.

It does not authorize Touch & Store LLC to sell your User Content or independently use it in advertising or commercial campaigns unrelated to providing PhotoPost.AI to you.

PhotoPost.AI does not use User Content to train its own general-purpose artificial intelligence models unless the user has separately and expressly agreed to such use.

You represent that you have the rights and permissions necessary to provide User Content to PhotoPost.AI and to authorize its processing as described in these Terms.

Content Generated for You

Subject to applicable law and third-party rights, you may use content generated specifically for you through PhotoPost.AI for your business and social media communication.

Because artificial intelligence systems may generate similar or identical material for different users, PhotoPost.AI does not guarantee that generated text, ideas, structures, images or other output will be unique or capable of exclusive intellectual-property protection.

You are responsible for reviewing generated content for third-party rights before using or publishing it.

Touch & Store LLC does not claim ownership of your original User Content merely because it has been processed through PhotoPost.AI.

Connected Social Networks

PhotoPost.AI may connect with third-party social networks and services, including, where available:

  • Facebook;
  • Instagram;
  • LinkedIn;
  • Pinterest;
  • Snapchat;
  • TikTok;
  • X.

These services are independent third parties and are not controlled by Touch & Store LLC.

By connecting a third-party account, you authorize PhotoPost.AI to access and use the permissions you approve for the purpose of providing the requested functionality.

You remain subject to the terms, policies and requirements of each connected platform.

Connection and publishing availability may depend on each social network’s permissions, API rules, access level, technical requirements or provider approvals.

A connection to a network does not guarantee that every publication capability will be available at all times.

Third-Party Names and Trademarks

Facebook, Instagram, LinkedIn, Pinterest, Snapchat, TikTok, X and any other third-party platform names, trademarks, logos, service marks, product names and related brand assets are the property of their respective owners.

References to third-party platforms in PhotoPost.AI are made solely to identify compatible or connected services.

Such references do not imply ownership by Touch & Store LLC, sponsorship, endorsement, partnership or affiliation unless expressly stated by the relevant third party.

No rights in third-party names, trademarks, logos or other brand assets are granted to users under these Terms.

Scheduling and Publishing

Where scheduling or publishing is available under your plan, you may instruct PhotoPost.AI to prepare, schedule or submit approved content to a connected social network.

You remain responsible for the content and publishing destination you approve.

A scheduled time is an instruction to attempt publication at or around the requested time.

Actual delivery may depend on:

  • network availability;
  • provider processing time;
  • API availability;
  • account permissions;
  • provider rate limits;
  • provider review or approval status;
  • other technical conditions outside PhotoPost.AI’s reasonable control.

PhotoPost.AI does not guarantee that a third-party platform will accept or publish a submission at the requested time.

Third-Party Refusal, Removal and Account Actions

A connected social network may independently:

  • reject a publication;
  • delay publication;
  • remove published content;
  • limit its distribution or reach;
  • revoke API permissions;
  • restrict features;
  • suspend or terminate a social account;
  • change its API, policies or technical requirements.

Touch & Store LLC does not control those decisions and cannot guarantee that a third-party service will accept, display, maintain or distribute content.

PhotoPost.AI is not responsible for a third-party platform’s independent decision or failure, except to the extent that liability cannot lawfully be excluded.

Acceptable Use

You must not use PhotoPost.AI to submit, request, generate, transform, schedule or publish content where doing so would violate applicable law, third-party rights, these Terms or applicable platform policies.

Without limitation, you must not use PhotoPost.AI to:

  • publish or generate unlawful, fraudulent or deceptive content;
  • infringe intellectual-property rights;
  • use a person’s image, identity or other protected rights without the authorization required by law;
  • make unlawful or deliberately deceptive commercial claims;
  • engage in spam or abusive automation;
  • impersonate another person or business without authorization;
  • distribute malware or malicious code;
  • interfere with the security or operation of PhotoPost.AI;
  • circumvent safety systems, plan limits, access controls or platform restrictions;
  • access another user’s account without authorization;
  • manipulate a social platform or circumvent its rules;
  • reverse engineer or attempt to extract source code except where such restriction is prohibited by applicable law.

PhotoPost.AI may take reasonable measures to prevent abuse and protect the Service, users and connected platforms.

PhotoPost.AI Intellectual Property

PhotoPost.AI, its software, interface, technology, designs, trademarks, logos, documentation and other proprietary materials are owned by Touch & Store LLC or its licensors.

Except for the limited rights necessary to use the Service, these Terms do not grant you ownership of PhotoPost.AI or its underlying technology.

You may not copy, reproduce, sell, sublicense, misuse or commercially exploit PhotoPost.AI except as expressly permitted by Touch & Store LLC or applicable law.

Service Availability and Changes

We work to keep PhotoPost.AI available and reliable, but uninterrupted availability cannot be guaranteed.

We may update, improve, modify, suspend or temporarily interrupt parts of the Service for maintenance, security, provider changes, legal, technical or operational reasons.

We may add, modify or remove features over time.

Where a material change significantly affects a paid subscription, we will provide information about the change when reasonably required by its nature or applicable law.

No Guarantee of Business Results

PhotoPost.AI is a communication and productivity tool.

We do not guarantee:

  • any particular increase in visibility or reach;
  • followers or audience growth;
  • engagement levels;
  • leads;
  • customers;
  • sales;
  • revenue;
  • search or algorithmic ranking;
  • acceptance or distribution of content by a social network;
  • any particular commercial result.

Results depend on many factors outside PhotoPost.AI’s control, including the user’s business, content, audience, market, social-network algorithms and third-party platform policies.

Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, PhotoPost.AI is provided on an “as available” basis and without warranties that are not expressly stated in these Terms.

Touch & Store LLC is not responsible for indirect, incidental, special or consequential losses resulting solely from the use or inability to use the Service, third-party platform decisions or reliance on AI-generated suggestions, to the extent such liability may lawfully be excluded.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Suspension and Termination

We may temporarily restrict or suspend access to PhotoPost.AI where reasonably necessary because of:

  • serious or repeated violation of these Terms;
  • unlawful activity;
  • spam or abusive automation;
  • security threats;
  • unauthorized access;
  • misuse of connected social platforms;
  • non-payment of amounts due;
  • requirements imposed by law or a third-party platform;
  • conduct that materially threatens the Service or other users.

Where appropriate and reasonably possible, we may provide notice or an opportunity to correct the issue.

We may terminate an account where a serious breach cannot reasonably be remedied or where continued service would create a legal, security or platform-compliance risk.

The user may stop using PhotoPost.AI and may request account deletion through the mechanisms provided by the Service.

Privacy and Data Protection

Additional information about service providers that may process data on our behalf may be made available on our Subprocessors page.

These Terms do not replace those privacy notices.

Changes to These Terms

We may update these Terms when necessary to reflect changes to the Service, applicable law, security requirements, third-party platforms or our business operations.

The current version and its effective date will be published on this page.

Where a change materially affects existing users or their paid subscription, we will provide reasonable notice where required by applicable law or appropriate in light of the change.

Continued use of PhotoPost.AI after updated Terms become effective may constitute acceptance where permitted by applicable law. If applicable law requires a different form of consent, we will use the required method.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without prejudice to any mandatory rights or protections that apply under the law of another jurisdiction and cannot legally be waived.

Nothing in these Terms prevents a user from relying on mandatory legal protections that apply to them.
